Terms of Service

Last updated September 18, 2026

Welcome to ArtMax (“ArtMax,” “we,” “us”). These Terms of Service (“Terms”) govern your access to and use of the ArtMax application and website, including its professional workspaces (together, the “Service”). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. What ArtMax is — and is not

ArtMax is a research and documentation tool for objects — fine art and antiques, collectibles, and everyday finds. You give it a photograph, a listing link, a document, or the details of an object, and it assembles research from public sources and AI models, together with documents built from that research.

The Service is for information and research only. It is not professional advice, and its outputs are not appraisals. ArtMax does not provide investment, financial, legal, tax, or insurance advice, and nothing in a report is a recommendation to buy, sell, or hold any work or asset. ArtMax is not an art appraiser, authenticator, conservator, auctioneer, or dealer. No output of the Service is an appraisal within the meaning of the Uniform Standards of Professional Appraisal Practice (USPAP) or any similar standard, a certificate of authenticity, a condition report, or a guarantee of title, provenance, value, or investment outcome.

Before committing money to any acquisition — or pricing an item for sale — you should independently verify every material fact and, where the stakes warrant it, consult qualified professionals. Decisions you make are your own.

Help requests. If you send a help request from an artwork or a Want, any help you receive in response is informal, personal assistance from ArtMax Art Advisor LLC. It is not an appraisal, an authentication, brokerage, fiduciary or investment advice, and it does not make ArtMax Art Advisor LLC your agent or create any ongoing professional relationship unless one is separately agreed in writing. We do not guarantee a reply, an outcome, a price or that any work is available. You remain responsible for your decisions.

2. Accuracy and AI-generated content

Reports are generated in part by automated systems and third-party AI models, and by researching public web sources. These systems and sources can be incomplete, out of date, or wrong. Full Research uses an initial research dossier and a separate AI model that checks it against the evidence; that model does not write the report. The check is intended to identify material errors, unsupported statements, uncertainty, contradictions, misleading wording, and important omissions. It is not a guarantee that every cited page was independently re-fetched or that every claim received a mechanical grade. Sources remain visible so you can inspect the evidence yourself. We make no warranty that any report, review, price range, or claim is accurate, complete, or fit for any particular purpose.

3. Professional and business use

You may use the Service for commercial purposes, including auction, estate-sale, antique, gallery, shop, or advisory work. Professional use comes with professional responsibility.

You set every price. The Service may report comparable sales, asks, and market evidence; it does not determine the price of your item. Estimates, tags, and asking prices you assign are your own commercial judgment.

You are the publisher of record. Review any document, tag, advertisement, listing, or social post before you publish or distribute it. You are responsible for its accuracy and legality in your hands.

Your clients rely on you, not on us. If you use the Service while acting for an estate, consignor, vendor, buyer, seller, or other third party, you remain responsible for your obligations to that party.

4. Your account and eligibility

You must be at least 18 years old to use the Service. Sign-in is by email. We may send a sign-in link or numeric code to the address you provide. You are responsible for keeping access to that email secure and for activity that occurs under your account. Tell us promptly if you believe your account has been accessed without permission.

5. Your content

You keep ownership of the listings, documents, images, inventory records, and details you submit (“Your Content”). You grant ArtMax a limited licence to process Your Content solely to operate, maintain, and provide the Service, including sending it to the third-party providers described in our Privacy Policy to generate and review your research, and storing it so your work persists where the product provides persistence.

You represent that you have the right to submit Your Content and that doing so does not violate the rights of others or any law. Do not upload confidential documents you are not permitted to share, or content that is unlawful, infringing, or malicious.

6. Share links and public pages

The Service may let you create public report links or other buyer-facing pages. Anyone who has a public link can view that page without signing in and can pass the link onward. Share only where you intend the research to be seen.

7. Connected platforms and publishing

The Service may format, export, or publish material to third-party platforms when you direct it to do so. You are responsible for your accounts, credentials, permissions, fees, and compliance with those platforms’ terms. We do not control their availability or records.

8. Acceptable use

You agree not to misuse the Service. In particular, do not attempt to overwhelm, scrape, reverse-engineer, or circumvent the Service or its rate limits; probe or breach its security; use it for unlawful, deceptive, or harmful purposes; or submit content that infringes others’ rights. We may suspend or terminate access that we reasonably believe violates these Terms or threatens the Service or other users.

9. Included reports and web purchases

Quick Look is free. Anonymous users can complete one free Full Research report. Eligible verified email accounts receive a one-time complimentary report allowance, shown in the account. Existing eligible accounts receive the same allowance when they next access their report balance. Prior free reports do not reduce this grant. Complimentary credits do not expire; changes to the allowance apply only to future grants.

Web purchases on artmax.art: additional report credits are sold as one-time purchases through Stripe. The price is shown before web payment. These purchases are not subscriptions, have no automatic renewals, and do not expire. ArtMax does not receive or store your full card details.

One report credit is used only when a completed, independently reviewed Full Research result is saved. Research that fails, is cancelled, times out, or has an incomplete review does not permanently use a credit. Reopening a saved report does not use another credit.

Our Refund & Cancellation Policy is part of these Terms. Its 7-day money-back promise applies only to your first qualifying payment on artmax.art through Stripe, not to complimentary reports.

10. Availability and changes

The Service is provided “as is.” Features may change, break, or be withdrawn, and the Service may be unavailable at times. We may update these Terms; if we make material changes we will update the date above and, where appropriate, give notice in the app or by email. Continued use after a change means you accept the updated Terms.

11. Disclaimers

To the fullest extent permitted by law, the Service and all reports and outputs are provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any result obtained through it is reliable.

12. Limitation of liability

To the fullest extent permitted by law, ArtMax and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or for any acquisition, pricing, or sale decision made in reliance on the Service or its outputs. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or US$100.

13. Indemnity

You agree to indemnify and hold ArtMax and its operators harmless from claims, losses, and expenses arising out of Your Content, materials you publish or distribute using the Service’s outputs, your use of a connected platform, or your misuse of the Service or violation of these Terms, to the extent permitted by law.

14. Dispute resolution; arbitration and class waiver

Most concerns can be solved fastest by emailing us first. Otherwise, you and ArtMax agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court and either party may seek injunctive relief for infringement or misuse of intellectual property. You and ArtMax each waive the right to a jury trial and the right to participate in a class action or class-wide arbitration.

You can opt out of arbitration by emailing us within 30 days of first accepting these Terms with your account email and a statement that you opt out of arbitration.

15. Governing law

ArtMax is operated by ArtMax Art Advisor LLC, a New Jersey limited liability company. These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. For any matter not subject to arbitration, the state and federal courts located in New Jersey will have jurisdiction, except where applicable law entitles you to bring a claim elsewhere.

16. General

These Terms, together with the Privacy Policy and Refund & Cancellation Policy, are the entire agreement between you and ArtMax about the Service. If any provision is found unenforceable, the rest remain in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, sale, or reorganization. Neither party is liable for delay or failure caused by events beyond its reasonable control.
